Welcome to PartyHubSA (“we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of https://www.partyhubsa.co.za (“the Website”).

By accessing or using PartyHubSA, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website.

1. About PartyHubSA

PartyHubSA is an online directory platform that connects customers with independent party and event suppliers across South Africa, including providers of:

Cakes and cupcakes
Balloon décor and balloon arches
Candy floss and sweet treats
Custom decorated cookies
Cake pops and rice krispie treats
Party boxes, lucky packets, and custom party packs
Baby shower, gender reveal, birthday, wedding, and corporate event suppliers
Other party and event-related services and products

PartyHubSA does not sell products or services directly to customers and is not a party to any agreement between a customer and a supplier.

2. Acceptance of These Terms

By using this Website, you confirm that you:

are at least 18 years old;
have the legal capacity to enter into a binding agreement; and
will comply with these Terms and all applicable South African laws.

3. Supplier Listings

3.1 Independent Suppliers

Suppliers listed on PartyHubSA are independent third parties. Each supplier is solely responsible for:

the accuracy of their listing information;
pricing and quotations;
product quality;
service delivery;
food safety compliance;
business registrations and licences;
insurance requirements;
delivery and collection arrangements; and
any warranties or guarantees they provide.

PartyHubSA does not endorse, guarantee, or certify any supplier unless explicitly stated otherwise.

3.2 Listing Accuracy

Suppliers must ensure that all information submitted is:

truthful and accurate;
kept up to date;
not misleading or deceptive; and
compliant with applicable laws and regulations.

We reserve the right to edit, suspend, or remove listings that contain false, offensive, unlawful, or inappropriate content.

4. Customer Enquiries

Customers may use the Website to search for suppliers and submit enquiries directly to them.

PartyHubSA:

does not participate in quotations, negotiations, bookings, or contracts between customers and suppliers;
is not responsible for whether a supplier responds to an enquiry;
is not responsible for the outcome of any booking, event, purchase, delivery, or service provided by a supplier.

Any agreement entered into between a customer and a supplier is solely between those parties.

5. Free and Paid Listings

5.1 Free Listings

PartyHubSA may offer free supplier listings with limited features.

5.2 Paid Subscription Plans

Suppliers may choose to subscribe to paid monthly plans that provide additional features, visibility, or promotional benefits.

5.3 Featured and Promoted Listings

Suppliers may purchase featured or promoted placement to increase the visibility of their listing on the Website.

Payment for subscriptions and promotions is processed through PayFast or another approved payment gateway.

6. Payments

6.1 Payment Processing

PartyHubSA uses PayFast to process supplier subscription and promotion payments. By making a payment, you also agree to PayFast’s terms and privacy policies.

6.2 Renewals

Where a subscription is recurring, the supplier authorises the applicable recurring payment until the subscription is cancelled.

6.3 Refunds

Unless required by law:

subscription fees are non-refundable once the subscription period has commenced;
promotional or featured listing fees are non-refundable once the promotion has been activated.

7. Account Registration

To create a supplier account, you must provide accurate and complete information.

You are responsible for:

maintaining the confidentiality of your login credentials;
all activities that occur under your account; and
notifying us immediately of any unauthorised use of your account.

We may suspend or terminate accounts that are used fraudulently, abusively, or in violation of these Terms.

8. Prohibited Conduct

Users may not:

submit false or misleading information;
impersonate another person or business;
upload unlawful, defamatory, abusive, or offensive content;
infringe any copyright, trademark, or other intellectual property rights;
distribute spam, malware, or harmful code;
attempt to gain unauthorised access to the Website or its systems;
use automated tools to scrape or copy Website content without permission.

9. Reviews and User Content

If reviews, ratings, comments, or other user-generated content are enabled, you agree that your content:

is based on genuine experience;
is fair and lawful;
does not contain defamatory, abusive, discriminatory, or misleading statements; and
may be displayed publicly on the Website.

the PartyHubSA name and logo;

directories, categories, and databases,

is owned by or licensed to PartyHubSA and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit any Website content without prior written permission.

Suppliers retain ownership of the logos, images, and content they upload, but grant PartyHubSA permission to display that content as part of their listing and for related promotional purposes.

11. Disclaimer

PartyHubSA provides the Website and its content on an “as is” and “as available” basis.

While we work hard to maintain a useful and reliable platform, we do not guarantee:

the accuracy or completeness of supplier listings;
the availability of any supplier, product, or service;
uninterrupted or error-free operation of the Website; or
that the Website will meet your specific requirements.

PartyHubSA is a directory and advertising platform only and does not supervise or control the services provided by listed suppliers.

12. Limitation of Liability

To the fullest extent permitted by South African law, PartyHubSA and its owners, employees, and affiliates will not be liable for any:

direct or indirect loss;
loss of profits, revenue, data, or business opportunities;
event failure or cancellation;
poor workmanship or defective products;
late delivery or non-delivery;
personal injury, property damage, or any consequential loss arising from dealings between customers and suppliers.

Your use of the Website is entirely at your own risk.

13. Indemnity

You agree to indemnify and hold harmless PartyHubSA from any claims, damages, liabilities, costs, or expenses arising from:

your use of the Website;
your breach of these Terms;
your supplier listing or user content; or
any dispute between you and another user, customer, or supplier.

14. Privacy and POPIA

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).

15. Suspension and Termination

We may suspend, restrict, or terminate access to the Website or remove any listing if:

these Terms are violated;
payment for a subscription or promotion is not received;
unlawful or harmful activity is suspected; or
continued use poses a risk to PartyHubSA or its users.

Termination does not affect any rights or obligations that arose before termination.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business operations, or legal obligations.

Updated Terms will be posted on this page with a revised Effective Date. Continued use of the Website after changes are published constitutes acceptance of the updated Terms.

17. Governing Law
